Devonshire Pointe Homeowners Association Meeting April 16, 2014

Attending: Chris Schmidt, Heinz Mantel, Marius Gavrila, Carol Pascarella, David Riley, Laura Baker, Erik Lundry, Kevin Cullen and Deneen Worthen

Treasurer’s Report: Marius submitted the financial report for review. He drew the Board’s attention to a few items:

·         The initial collection of dues has ended. Twenty-four homeowners needed reminders/overdue notices. Out of those 24 homeowners, eight homeowners are still in arrears … two significantly behind.

·         Referring to the balance sheet, $15,000 has been placed into our emergency fund.

·         Speaking in detail regarding our profit and loss statement, we have spent $2,800 this year as was expected.

The discussion focused on how to handle the two most serious offenders; their owed dues amounting to almost $3,500. These funds are needed to support our operational cost that supports this community. We are going to send another final notice to the eight homeowners who owe the Association dues. This is an effort to get everyone paid up. After sharing a discussion had with our attorney, Heinz relayed our two options for the two major offenders; either file a lien against the property or start foreclosure proceedings. The board needs to make a decision regarding how to proceed.

The decision was made to send the two offenders by certified mail a legal notice that we are considering foreclosing on the property. Then the matter will be handled by the attorney from there.

Maintenance/Landscaping: Erik contacted Ken at Groundskeepers and we will be using them to maintain the two entrances. There will be a $5 – $10 increase.

Heinz added that all service agreements are in place with Aquatic Weed, Bill’s Sprinkler, and Groundskeepers. It was decided that we would have the same plantings at the entrances as but as an added barrier, we would be adding mulch.

Social Committee Report: Carol recapped our 3rd Annual Easter egg hunt; 24 children hunted for 500 eggs. Carol suspected that the timing of the egg hunt (it fell on a weekend during the spring break recess) made for a small event. We had plenty of advertising with a postcard reminder. It was brought up that we need signposts at the entrances. Other upcoming dates:

·         Garage sale will be Thursday, Friday and Saturday 8-3 and 8-3 and 8-12. The ad will be in the South Bend Tribune and on Craigslist.

·         July 4th parade and ice cream social will start at 9:00 am. Clay fire will be present. We will need to send a postcard reminder.

·         Planning for “Get to Know your Neighbors” night is in the works with a possible Sept/Oct date.

Communications: David captured a few more emails and we are now up to 85 valid homeowners email.

Architectural control: We agreed to add a blurb in the newsletter reminding homeowners planning spring projects to seek approval

Covenants: The board is ready to roll out our post light program. A letter is being created Deneen to explain what the Post Light program to our neighbors and we will offer details in the upcoming newsletter. We will be distributing 25 or 40 volt lightbulb or a 40 volt candlelabra.

Additional Comments: One of our homeowners has a fallen tree that has not been removed for more than 6 months. What can be done about this? After consulting the covenants we realized that we have no specific ordinances requiring homeowners to remove fallen trees. Heinz is going to investigate the County ordinances to see if there is a way to encourage this neighbor to be responsible regarding the maintenance of their lawn.
